Terms & Conditions – Cool Cabana Rental

These Terms & Conditions (“Terms”) apply when you hire equipment from Cool Cabana Rental (“we”, “us”, “our”). By placing a booking and making payment, you (“you”, “the customer”, “the hirer”) agree to the following:

1. Hire Agreement

  • You are hiring a Cool Cabana for personal use during the agreed hire period.
  • Hire begins at the confirmed delivery date and ends when the cabana is returned or collected. The morning of return is not charged.

2. Payment

  • Full payment is required at the time of booking.
  • Prices are listed in Australian Dollars (AUD) and include GST.
  • Security deposits apply. Deposits will be pre authorised in your account and placed on hold. This hold will be removed once the equipment is returned in good condition, subject to inspection. Normal wear and tear is expected but theft or deliberate vandalism will forfeit your full deposit amount.

3. Cancellations & Refunds

  • Cancellations made more than 24 hours before the booking start time: full refund.
  • Cancellations within 24 hours: no refund for first day, full refund for subsequent days of hire.
  • If we cancel due to unsafe conditions (e.g., extreme weather) or equipment unavailability, you will receive a full refund.

4. Customer Responsibilities

  • You must use the Cool Cabana safely, responsibly, and as intended (for shade purposes only).
  • You are responsible for ensuring the cabana is properly set up, anchored, and supervised at all times. Wind conditions must be taken into account.
  • Do not leave equipment unattended on the beach.
  • You must return the cabana in the same condition it was hired, with the exception of what would be considered normal wear and tear.

5. Damage, Loss, or Theft

  • You are responsible for any loss, theft, or damage (beyond normal wear and tear) during your hire period.
  • Repair or replacement costs will be deducted from your deposit.

6. Safety & Liability

  • Beaches and outdoor environments carry inherent risks. You agree to use the cabana at your own risk.
  • We are not liable for:
    • Injury, accident, or property damage arising from misuse or unsafe setup.
    • Weather conditions, including wind or tides, that affect safe use.
  • Our liability is limited to the hire fee paid by you.

7. Weather Conditions

  • Hire is weather dependent. If conditions are unsafe (high winds, storms, etc.), we may refuse hire, cancel, or recall equipment for safety reasons. Full refund will be issued in this scenario.

8. Returns & Collection

  • Equipment must be returned/available for collection at the agreed time and location. Contact can be made with Cool Cabana Rentals over the phone if you need to change delivery or return location.
  • Late returns will incur additional charges and will delay all other delivery and returns that day. Adherence to agreed time slots is crucial.

9. Governing Law

  • These Terms are governed by the laws of New South Wales or Queensland, Australia.
  • Any disputes will be handled in New South Wales or Queensland courts.

10. Acceptance

By checking out and completing payment, you confirm that you:

  • Have read and understood these Terms & Conditions.
  • Accept responsibility for the hired equipment during the hire period.
